How a Domestic Violence Restraining Order Can Help You
A domestic violence restraining order is a way to get immediate safety from spousal abuse, assault and battery and other family violence. You may request a restraining order against a relative, spouse, ex-spouse, close household member, boyfriend/girlfriend or your child's parent.
Through a restraining order, a court can order your abuser to:
- Not contact you or your children through any means
- Move away from you and your children
- Follow all court orders, including child custody, visitation, child support and spousal support orders
Temporary and Permanent Restraining Orders
When you petition for a restraining order, the court will first give you a temporary restraining order until your court date. The court will then determine whether or not it should order a permanent restraining order. A permanent order for protection can last up to five years.
